As part of our mission to build up the Global Health workforce, we collect and process information. Below you will find ThriveHire’s terms and conditions. This is intended to help you better understand how we collect, use and store your information—whether you are an employer, job seeker, or simply visiting the website.

Please read the terms in full before using this website. By using our website, you agree to the provisions of these Terms and our Privacy Policy. If you do not accept these terms, please do not use the website.

We may update these Terms from time to time. If we make material changes to these terms, we will give you notice of such changes by posting the revised terms on this website, and where appropriate, by other means. By continuing to use this website after these changes are posted, you are agreeing to the revised policy.

You further acknowledge and agree that ThriveHire shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services.

We advise that you read the terms and conditions and privacy policies of any third-party websites or services that you visit.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

We take all reasonable steps to ensure that the information posted on our website is correct. However, we do not guarantee the correctness or completeness of material on this website. Neither we nor any other party (whether or not involved in producing, maintaining or delivering this website), shall be liable or responsible for any kind of loss or damage that may result to you or a third party as a result of your or their use of our website. This exclusion shall include servicing or repair costs and, without limitation, any other direct, indirect or consequential loss, and whether in tort or contract or otherwise in connection with this website.

TERMS OF SERVICE FOR JOB SEEKERS

The following terms and conditions apply to all Job Seekers and other users who access or use the Site as intended for individuals seeking to find employment openings. This agreement is made between ThriveHire Inc. (the “Platform”, “Site,” “us” or “our”) and a Job Seeker (“you” or “your”). Your material, once published on our Platform, will be subject to the terms and conditions below:

1. Your consent means that you have granted ThriveHire the right to display your content in digital form on our Platform, specifically on our website, www.thrivehire.org (which is linked to www.thrivehire.co, www.thrivehire.io, www.thrivehire.ca).

2. When you create a ThriveHire account, upload a profile or post content, you grant us permission and right to use your information on the Platform. Information may include but is not limited to your name, email address, work information, and types of opportunities you are seeking. By supplying us with these materials and/or other documentation, you confirm that the information you provide is accurate. You also permit users of the ThriveHire Platform to download and print the materials displayed on the Platform for personal use.

By creating a profile through the Site, you are requesting and authorizing ThriveHire to make available your information to any Employer that ThriveHire believes may have an interest in your profile. By entering material on ThriveHire, ThriveHire may share with you job, internship, volunteer or event listings that match the contents of your user profile.

ThriveHire may also send you recommended opportunities via the email address or phone number you use to create a ThriveHire account on the Site or to apply to a job. ThriveHire may determine what these recommended jobs are on the basis of a variety of factors, including but not limited to, any information you input on the Site about yourself, searches you run on the Site, jobs you apply to, or the materials you provide in a job application to an Employer through ThriveHire.

3. When you apply to a job, internship or volunteer listing using ThriveHire, ThriveHire will attempt to send your application to the contact information provided to us by an Employer. We cannot guarantee that such messages and applications will be delivered, read or acted upon. In addition, although we will make measures to ensure the information provided on the platform is correct, we cannot guarantee the validity of the contact information provided to us by Employers. We also cannot vouch for the technical capabilities of any third party sites. If you do not feel comfortable sending an application or messages in this manner, please do not use the Apply functions on the Site and please send your application or messages directly to the Employer by whatever other method you so choose. You may contact the Employer directly to find alternative methods of application if you do not wish to apply through ThriveHire. By using the ThriveHire Apply system, you fully consent to the above.

By using ThriveHire, you agree that ThriveHire is not responsible for the content of the Employer’s job application, screener questions, skills assessments or their format or method of delivery, and that ThriveHire does not guarantee receipt of your application by the Employer, or your receipt of messages from the Employer. Please note that ThriveHire does not choose the questions asked by Employers or decide the job qualification criteria of Employers. ThriveHire does not guarantee that uploading or updating a user profile or application will result in any job offer. Job Seekers are responsible for verifying the accuracy of any Employer or job offer.

4. These Terms, together with the Privacy Policy, and any other legal notices published on the Website, shall constitute the agreement between you and ThriveHire concerning your use of the Services. These Terms will continue until such time as ThriveHire determines in its sole discretion to update the term of this agreement or remove the materials, or you choose to have your materials removed from the Platform.

5. ThriveHire will not be liable for any loss or damage incurred by posting your materials on our platform. ThriveHire is also not liable to pay any fees for the use of the materials.

6. ThriveHire shall not sell the materials that you provide ThriveHire.

7. ThriveHire is the owner of intellectual property rights relating to the Platform including but not limited to content, graphics, videos, audio files, data. Enginehire, the third-party website service provider, is the owner of intellectual property rights of any tools developed and/or used by Enginehire, including but not limited to software such as source code, web authoring and application tools, together with general non-copyrightable concepts such as website design, architecture, layout, navigational and functional elements. However, you shall retain all rights with respect to the materials and content you provide ThriveHire.

8. You can choose to immediately pull information without penalty from ThriveHire if you feel it may be damaging or unacceptable to you. If you had been charged a fee to use a Service, no refunds will be made by choosing to pull information from the site.

9. You will be notified of changes to this contract. Any material changes to these terms and conditions will be sent to you with a 30-day notice.

TERMS OF SERVICE FOR EMPLOYERS

The following terms and conditions apply to all Employers and other users who access or use the Site as intended for individuals and/or organizations seeking to make available information regarding employment openings. This agreement is made between ThriveHire Inc. (the “Platform”, “Site,” “us” or “our”) and an Employer (the “Author”, “Company”, “Organization”, “you” or “your”). Your material, once published on our Platform, will be subject to the terms and conditions below:

1. Your consent means that you have granted ThriveHire the right to display your content in digital form on our Platform, specifically on our website, www.thrivehire.org (which is linked to www.thrivehire.co, www.thrivehire.io, www.thrivehire.ca), and through our social media (www.twitter.com/ThriveHire, www.linkedin.com/company/thrive-hire/, www.facebook.com/ThriveHire/) and newsletter channels.

2. When you create a ThriveHire account, a company profile page or post job or event listings and other content, you are granting us permission and right to use your company’s materials on the Platform. Materials will be supplied by you and include but are not limited to your company’s name, company information, website URL, social media links, images, and logo. By supplying us with these materials and/or other documentation, you confirm that you have the authority to do so on behalf of your organization and that the information you provide is accurate. You also permit users of the ThriveHire Platform to download and print the materials displayed on the Platform for personal use.

3. By filling out a job, volunteer and/or event listing on ThriveHire, you confirm that the content does not violate any existing intellectual property rights and the content complies with applicable local, state/provincial, federal and international laws, including but not limited to laws relating to anti-discrimination, labor and employment, equal employment opportunity and employment eligibility requirements, data privacy, data access and use, and intellectual property. ThriveHire reserves the right to decline any listing as it deems appropriate.

4. ThriveHire may make available to you certain screening tools for use during the application process, including screener questions. ThriveHire is licensing these tools to you for your use as you determine. By using any screening product made available to you by ThriveHire, you agree that you have made the determination to use these tools as part of your application process, and the substantive questions you ask or choose are solely determined by you, and are not being asked by ThriveHire. You are solely responsible for the use of the screening tool. You further acknowledge that you are responsible for offering alternative methods of screening, including non-discrimination acts.

ThriveHire may use Job Seekers’ application materials (including user profile information and responses to screener questions) and the recency of their activity on ThriveHire to determine whether the applicant matches the criteria of your Job Listing, and vice-versa. You further agree and consent that ThriveHire may differentiate those matching your screener questions from those that do not match, and present them to you as matches or not matches. ThriveHire may also use such information in order to improve the Site or any other ThriveHire product or service.

5. ThriveHire will give you full credit for the content used on our Platform.

6. ThriveHire shall provide a link to the Author’s website and/or social media platforms on the Platform.

7. These Terms, together with the Privacy Policy, and any other legal notices published on the Website, shall constitute the agreement between you and ThriveHire concerning your use of the Services. These Terms will continue until such time as ThriveHire determines in its sole discretion to update the term of this agreement or remove the materials, or you choose to have your materials removed from the Platform.

8. ThriveHire will not be liable for any loss or damage incurred by posting your materials on our platform. ThriveHire is also not liable to pay any fees for the use of the materials.

9. ThriveHire shall not sell the materials that the Author provides ThriveHire.

10. ThriveHire is the owner of intellectual property rights relating to the Platform including but not limited to content, graphics, videos, audio files, data. Enginehire, the third-party website service provider, is the owner of intellectual property rights of any tools developed and/or used by Enginehire, including but not limited to software such as source code, web authoring and application tools, together with general non-copyrightable concepts such as website design, architecture, layout, navigational and functional elements. However, you shall retain all rights with respect to the materials and content you provide ThriveHire.

11. ThriveHire reserves the right to make non-material edits to the content provided in order to keep within space restrictions.

12. The Author can choose to immediately pull postings and information without penalty from ThriveHire if the Author feels advertising may be damaging or unacceptable to their organization. If the Author had been charged a fee to post content, no refunds will be made by choosing to pull information from the site.

13. The Author will be notified of changes to this contract. Any material changes to these terms and conditions will be sent to the Author with a 30-day notice.
